The sponsor of the Contest is USAopoly, Inc. (“The Op”). Disney is not a sponsor

ENTRANT ELIGIBILITY

The Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or older on the date of entry, provided that for any event in Alabama or Nebraska the participant must be at least nineteen (19) years of age. Employees, officers, directors, members, and owners, and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household (whether or not related) of Sponsor, Disney, Gen Con, and the store(s) or other locations where any Contest Event occurs (each, an “Event Site”), and each of the foregoing’s respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any other person or entity associated with the Contest are not eligible to participate or win a prize. The Contest is subject to all applicable laws, rules, and regulations. Void outside the eligible territory and where prohibited or restricted by law, rule, or regulation.

TIME AND LOCATION OF CONTEST EVENTS

Contest Events will occur from approximately January 14, 2023, through June 25, 2023, and will be held at various Event Sites. There will be approximately ten (10) Contest Events. Sponsor and the Event Site will announce each event approximately _15__ or more days in advance. Sponsor reserves the right to add, cancel, reschedule, and/or re-locate any or all Contest Events at any time for any reason in its sole and absolute discretion and without prior notice. Participants are solely responsible for any expenses incurred to travel to any Contest Event, regardless of whether the Contest Event is held as advertised.

HOW TO ENTER

Each person is eligible to enter and play in only one (1) Contest Event. Each entrant must register with the individual Event Site at which the entrant wishes to play. Registration for each Contest Event will be on a first come, first served basis. No more than thirty two (32) participants will be allowed to compete at any Contest Event. There must be at least four (4) registered participants for the Contest Event to be held. Registration may be in-person or online. To register, you will be required to provide your name, email address, phone number, address, birthday and any other information required by the Sponsor or Event Site. Participants must fully complete and submit all non-optional data requested to be eligible. Incomplete and/or inaccurate entries are void. Any person who registers for a Contest Event and then is either late or does not appear may be disqualified in the Sponsor’s sole and absolute discretion. Sponsor has no obligation to reschedule any Contest Event or provide any alternate Contest Event to accommodate any participant.

WHAT TO BRING

Each participant must bring to the Contest Event all of the following items:

  • the game board and all four (4) reference cards from The Op’s Disney Sorcerer’s Arena: Epic Alliances Core Set;
  • three (3) blue and three (3) red Summoner Identifier Rings;
  • three (3) or more characters and all associated components from any of The Op’s Disney Sorcerer’s Arena: Epic Alliances Core Set, the Turning the Tide expansion pack, Thrills & Chills expansion pack, Leading the Charge expansion pack (after release), and Expansion Pack 4 (after release), including for each character:
    1. the character figure standee,
    2. the character ability card,
    3. the complete character card deck (10 Battle Cards total),
    4. the character turn token; and
    5. the rules if the character is from an expansion pack;
  • a supply of Turn Markers;
  • a supply of Status Effect Tokens;
  • a supply of Victory Point Tokens;
  • a means to keep score such as paper and pencil.

All of the foregoing Game components must be the original, complete, and unadulterated components from The Op’s Game and must be in acceptable playing condition. The sole exception to the foregoing is that a participant may use suitable substitutes for the Status Effect Tokens, such as pennies. Official The Op alternate art character figure standees are permitted. Players may use sleeves for their decks, and official foil promo cards are permitted, but proxy, third party or self-created cards and characters are not. If a player chooses to use foil cards, those cards must replace the corresponding card(s) in their deck, and their deck must be sleeved.

Any participant who fails to bring the necessary components or brings components that are adulterated, not original, not in playable condition or otherwise not in compliance with these Official Rules may be disqualified in the Sponsor’s or Event Site’s sole and absolute discretion. A participant may ask to borrow any missing component from another participant; provided that no participant is required to loan any component to any other participant or to bring excess supplies for other participants. Event Site, in its sole discretion, may provide a supply of excess components for participants’ use, but is not obligated to provide any components or any particular selection or quantity of components. Sponsor and Event Site are not responsible for any loss of or damage to the participant’s Game or Game components during the Contest Event.

Participants are advised that each Contest Event may last five (5) hours or more and are advised to bring their own food and water. Event Sites may but are not obligated to provide any food or water.

PARTICIPANT BEHAVIOR

Participants may not engage in any rude, offensive or disruptive behavior at any Contest Event, including but not limited to any expressions of racism, sexism, homophobia, discrimination, or hate speech; threats; insults; rudeness; belligerence; and other non-professional or uncivil behaviors. Further, participants may not cheat, collude, or engage in any other conduct to circumvent the rules of the Game or the Contest. Any participant who, in Sponsor’s and/or Event Site’s sole and absolute discretion, violates these standards may be disqualified.

GAME PLAY RULES FOR CONTEST EVENTS

The Game will be played at each Contest Event solely in a one-against-one format. No team play is allowed. Participants may not obtain or seek advice from any other person during a Contest Event.

Game play during Contest Events use the full Chapter 4 rules from the Game’s core set rulebook as clarified by the official errata available in the FAQ for the Game on The Op’s website, which may be updated at any time (see below for link), and the auxiliary rules for any expansion packs, provided that the following modifications shall apply:

  1. At the start of each round, each participant shall draft their team of characters from their own supply of characters, following a serpentine draft as outlined on page 13 of the Core Set rules. First pick is determined by a balanced randomizer, such as a coin flip or die roll. Two competing participants may agree to an intentional draw of characters (again, from each participant’s own supply of characters) rather than using the serpentine draft, in which event both participants shall reveal their drafted characters at the same time.
  2. A tie at the end of a round of a Game (i.e., the final sequence of character turns during the Game) is considered a draw.
  3. The final round of a Game is determined when any of the following occur: a participant collects their twentieth (20th) Victory Point, a player needs to draw a card from an empty deck, or the time for playing that Game during the Contest Event expires.

Link to Game rules errata

Before play begins in any round, a participant may request to verify their opponent’s character decks. As the character decks in the Game are pre-constructed, all a participant need verify is that one copy of each card for that deck is present, and that the cards or sleeves are in satisfactory condition, with the backs free of intentional markings or other adulteration. The assistance of a judge may be requested. If a judge determines, in the judge’s sole and absolute discretion, that one or more characters may not be played or that any Game piece has been adulterated or otherwise violates these Official Rules, the character may be removed or the participant may be disqualified in Sponsor’s and/or the Event Site’s sole discretion.

NO COLLUSION OR RULE BREAKING

During the Contest Event, each participant must strictly adhere to the rules of the Game. Any participant who, in the sole and absolute discretion of Sponsor or Event Site, does not adhere to the rules; uses any method other than playing the Game according to its rules to determine the winner (such as rolling a die, “rock, paper scissors”, or a random card draw); offers compensation to any other participant; and/or attempts to coerce any other participant will be disqualified.

CONTEST EVENT TOURNAMENT STRUCTURE AND SCORING

The tournament structure for each Contest Event is a non-elimination, event point-based pairing system, commonly known as a “Swiss” format. This structure allows for players to drop from the event before any round or game without impacting the pairings of subsequent rounds.

There will be five rounds of the Game played in each Contest Event. The number of rounds may be lowered in the Sponsor’s or Event Site’s sole and absolute discretion if the number of participants at the Contest Event is twelve (12) or fewer. During each round, a participant will play only one (1) Game. If the Game ends before the round is over, the participants should wait and not start another Game. If time for the round expires before the Game is finished, then participants shall finish their turns in the Game and the Game shall end. If there are an odd number of participants at a Contest Event, a participant may sit out a round of Game play (a “bye”).

Each round of Game play will last approximately fifty (50) minutes. There will be an approximately ten (10) minute break between each round. A longer lunch break may be provided but is not required to be given. All time keeping shall be done by Sponsor or the Event Site and their determination as to the start and stop times are final and binding. Any participant who does not return to Game play on time may be disqualified in the sole and absolute discretion of Sponsor and/or Event Site.

Sponsor and Event Site will appoint non-participating individuals to act on their behalf as judges to administer the Contest Event, keep time, resolve disputes and otherwise exercise the authority of the Sponsor and Event Site as described in these Official Rules. If there is a question about the rules of the Game or a Game piece, a participant may request clarification from a judge. The decisions of the judges are final and binding. In the event of any dispute between the appointed judges, the judge appointed by Sponsor shall control. In the event there is no judge appointed by Sponsor on-site, Sponsor may be consulted by phone and Sponsor’s decision shall be final and binding. If Sponsor is not available by phone, then the on-site judge’s final determination shall be binding. Judges cannot alter or amend these Official Rules.

At the end of each round of Game play, each participant shall report the final score of their Game to the Event Site. Each participant has the sole responsibility to accurately report their results to the Event Site. Sponsor is not responsible for any failure of a participant to accurately report Game play results. Any participant who does not accurately report their results may be disqualified in the sole and absolute discretion of Sponsor or the Event Site.

Participants will be randomly paired in the first round of Game play. If there are an odd number of participants at the Contest Event, one participant will be given a bye. The first-round bye is assigned at random, while the bye in subsequent round will be given to the participant with the then lowest score at the Contest Event. In the event of a tie for lowest score, the bye is awarded at random to the tying participants.

At the end of each round of Game play, participants are awarded points (“Event Points”) based on whether they won, tied, or lost the game or had a bye as follows:

Win or bye = 3 event points
Draw = 1 event point
Loss = 0 event points

Event Points are not the same as the Victory Points earned during Game play and are awarded regardless of the margin of victory.   Any dispute as to the final score or result of any Game play shall be resolved by the judge(s) and their determination shall be final and binding.

After the final round of the Contest Event, the participants at that Contest Event shall be ranked by the number of Event Points earned and prizes will be awarded as described below. If there is a tie between participants at a Contest Event for the first prize level, the winner shall be the participant with the highest Opponents’ Win Rate. If there are two or more participants who have the same number of Event Points and the same Opponents’ Win Rate, then the winner shall be the participant with the highest Average Margin of Victory. The calculation of the Opponents’ Win Rate and Average Margin of Victory are described below and shall be determined by the judge(s), whose determination shall be final and binding.

In the event that two participants are tied for 2nd through 5th place, both participants will receive the prize allocation for that level, and the next level of prize allocation will be skipped. For example, if two participants tie for 2nd place, both participants, if eligible, will receive a 2nd  place prize and the next highest participant in the rankings will receive the 4th place prize.

Opponents’ Win Percentage: A participant’s Opponents’ Win Percentage is the average value of the Win Percentages of each of that participant’s opponents in the Contest Event (the total of all of the participant’s opponents’ Win Percentages divided by the number of opponents). Each opponent’s Win Percentage is determined by dividing their number of wins (not Event Points) at the Contest Event by the number of games they played during the Contest Event.

Average Margin of Victory: A participant’s Average Margin of Victory is calculated by taking the total value of the margins by which they won or lost each Game during the Contest Event and dividing that value by the number of games they played at the Contest Event.

RELEASES AND LIMITATIONS OF LIABILITY

By entering this Contest, each participant, on behalf of himself/herself and his/her heirs, successors, assigns, agents and representatives, and without further compensation of any kind, waives and releases the Contest Entities and any applicable third party fulfillment service and all of their respective employees, agents, successors and assigns (collectively, the “Released Parties”) from any and all claims that participant may now or hereafter have in any jurisdiction based on “moral rights” or unfair competition with respect to the exploitation of the Recordings or NIL.   Each participant agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against any Released Party or any other person in connection with this Contest (including travel to and from an Event Site and all time at the Event Site); and/or the award, acceptance, possession, use or misuse of any prize (including travel, hotel stays, and attendance at Gen Con); and/or the exploitation of the Recordings or NIL.

None of the Contest Entities shall have any obligation, responsibility, or liability with respect to: (i) notifications, communications, or materials sent from a participant to a Contest Entity or from a Contest Entity to a participant, that are lost, late, misdirected, garbled, inaccurate, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, post office or technical error of any kind, (ii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iii) power-related or weather-related events of any kind, and/or to any events not under Sponsor’s direct control, (iv) entries or other communications from participants that contain inaccurate information or do not comply with these Official Rules, or (v) errors, omissions, interruptions, deletions, defects, delays in operation or transmissions, theft, destruction, unauthorized access or alterations by participant or third parties.

Waiver of California Civil Code Section 1542. Further, entrants are advised that California Civil Code § 1542 provides that: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR. By entering this Contest, each participant, on behalf of himself/herself and his/her heirs, successors, assigns, agents and representatives, acknowledges that he/she understands the significance and consequences of California Civil Code § 1542 and, to the extent it may be applicable, elects to waive the benefits of its provisions, with the intent that this release and waiver of liability in these Official Rules shall include claims known or unknown, and unknown and unsuspected.

The Released Parties are not responsible or liable to any participant or winner or any person claiming through such participant or winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity, including, but not limited to restrictions on travel, movement, and large gatherings (whether or not the action, regulations, order, or request proves to be invalid), national emergency, equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, volcanic eruption, war (declared or undeclared), fire, flood, epidemic, pandemic, viral or communicable disease outbreak, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Contest Entities’ sole control. Upon awarding the prize, the Sponsor will have no further obligation to a winner.

Some jurisdictions do not allow the limitations or exclusion of liability, so the above may not apply to every participant.

INDEMNIFICATION

Each participant agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, losses, promises, causes of action, and/or liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participant’s participation in the Contest or any Contest-related activity, any act or omission of participant while at any Event Site, any act or omission of participant while accepting or using any award (including travel), and/or the exploitation of the Recordings or NIL (if the claim arises in whole or in part based on participant).
